Class Action Mechanics

Class action lawsuits can be complicated both because of the underlying subject matter and large dollar amounts that are often at stake.  However, in practice, the mechanics of the class action lawsuit can be explained as follows:

  • A named representative (someone who was harmed in the same manner as the other class members) is identified
  • The lawsuit is technically filed by the named representative (or representatives)
  • Our lawyers work to show:
    • How all members of the class were harmed in the same way, under similar circumstances and by the same defendants
    • That the named representative’s harm is similar to the harm suffered by many, and that the named representative will fairly protect the interests of all other class members
    • That the class action is the best way to handle the members’ claims (as opposed to joining a few plaintiffs’ cases together in a typical lawsuit)
  • Based on that showing, a judge must certify the class so that the class action can proceed
  • After receiving class certification, we work to locate other potential class members and give them notice of their rights
  • Class members have the right to opt-in to the class or opt-out

A court will typically approve class certification in cases where the class is large enough that it would be impractical for each person to independently pursue their own claim.  Once we have achieved class certification, our lawyers pursue the case much in the same way as any other type of case.  We continue to investigate, interview witnesses, and negotiate with the defendants’ lawyers and insurance companies. 

When we have reached a settlement award or final verdict, all members of the class are notified about how to receive their portion of the award.  In some cases, a separate fund is established if the number of class members is particularly large.
