New Jersey Consumer Class Action Lawsuit Attorneys

Experienced Consumer Class Action Lawsuit Attorneys Help Clients With Class Action Cases In Bergen County and Throughout New Jersey

Class actions are a type of lawsuit where multiple people join together to get justice for a wrong that has impacted them all. Ultimately, the class action system helps people achieve justice on a larger scale by banding together over a common goal—without the need for each party to separately retain a lawyer and argue their own case.

Our lawyers have the experience needed to win class action cases—in fact, we have a collective 120-plus years’ experience successfully helping clients across New Jersey.  We have won millions for our clients over the years.  Unlike impersonal big firms, however, we keep our practice at a moderate size so that we can continue to work closely with our clients to continue our track record of success.

We know how high the stakes are in a class action lawsuit.  Dozens, if not hundreds, of class members count on our team to help them get justice.  We take our responsibilities extremely seriously.  When you choose The Epstein Law Firm, P.A., you can expect compassion, dedication to justice and exceptional legal representation, in addition to a lawyer who you actually meet and speak to on a regular basis.

Class Action Mechanics

Class action lawsuits can be complicated both because of the underlying subject matter and large dollar amounts that are often at stake.  However, in practice, the mechanics of the class action lawsuit can be explained as follows:

  • A named representative (someone who was harmed in the same manner as the other class members) is identified
  • The lawsuit is technically filed by the named representative (or representatives)
  • Our lawyers work to show:
    • How all members of the class were harmed in the same way, under similar circumstances and by the same defendants
    • That the named representative’s harm is similar to the harm suffered by many, and that the named representative will fairly protect the interests of all other class members
    • That the class action is the best way to handle the members’ claims (as opposed to joining a few plaintiffs’ cases together in a typical lawsuit)
  • Based on that showing, a judge must certify the class so that the class action can proceed
  • After receiving class certification, we work to locate other potential class members and give them notice of their rights
  • Class members have the right to opt-in to the class or opt-out

A court will typically approve class certification in cases where the class is large enough that it would be impractical for each person to independently pursue their own claim.  Once we have achieved class certification, our lawyers pursue the case much in the same way as any other type of case.  We continue to investigate, interview witnesses, and negotiate with the defendants’ lawyers and insurance companies.

When we have reached a settlement award or final verdict, all members of the class are notified about how to receive their portion of the award.  In some cases, a separate fund is established if the number of class members is particularly large.

Class actions can be based on any number of different types of harm—from physical injuries caused by a defective medication to a financial loss sustained because of consumer fraud.  The key element to a class action is that the group of plaintiffs will have suffered the same type of loss under similar circumstances, based on the actions of the same defendant.

In all cases, that defendant is likely to fight tirelessly to avoid the class certification and the negative publicity that it inevitably generates.  Once we have achieved certification, the defendant will fight even harder to minimize financial exposure.  The Epstein Law Firm, P.A., our skilled lawyers are here to even the playing field as we work tirelessly to protect your rights.

Frequently Asked Questions About New Jersey Class Action Lawsuits

FAQ: Is achieving class certification in a class action a difficult process?

It can be. Judges have discretion over whether to approve class certification. Further, class action suits are often brought against large companies with a huge incentive to fight the class certification. The experience and skill of the class action lawyer is key to achieving class certification. Prior to gaining approval, we conduct a thorough and detailed investigation to identify strong class representatives and get the evidence needed to show class members suffered similar types of harm.

FAQ: Why is the experience of my class action lawyer so important?

Class action lawsuits are subject to a complex and detailed set of rules. One missed filing deadline or procedural error can derail the entire lawsuit. Our lawyers have the knowledge of the law and specific class action requirements that can help you and every member of the class get the best possible outcome. Once we overcome the initial hurdle of achieving class certification, we use deep knowledge of the law to work to get the compensation you need.
