There are two major categories of disability benefits: temporary and permanent. Temporary benefits are paid during the time the employee is unable to work due to his/her injury and is under active medical treatment. These benefits are intended to be temporary and expire when the employee returns to work or has reached maximum medical improvement (MMI). Permanent disability benefits, either partial or total, may be paid after the employee has reached MMI from their injury and as a result of the injuries sustained has suffered some permanent loss of function. In cases where the employee is unable to do any work as a result of their injury, the individual may be entitled to receive total disability benefits.

The determination regarding whether an employee is able to work must be made by the doctor.
