Workers' Compensation

When you are hurt or injured while performing your duties as an employee in New Jersey, there is a specialized area of legislation that governs from whom and how much you can recover. Under New Jersey workers’ compensation laws, employers are required to provide workers compensation insurance coverage to each employee. Workers’ compensation differs substantially from other types of injury and death cases, and generally provides coverage for any necessary medical treatment related to the injury or illness and compensation for lost wages. The questions that arise most often in a workers’ compensation case are:

  • Whether you were an employee at the time of the injury?
  • Was the injury received while you were on the job?
  • Was there an injury?
  • What benefits are you entitled to?
  • Was the injury permanent?
  • Are you entitled to a settlement?
  • Should you accept a settlement?
  • Will the case be tried before a judge in the Division of Workers Compensation?
